1. Scope

These general terms and conditions (GTC) of ueneu GmbH apply to all contracts that a consumer (customer) concludes with ueneu GmbH by using the online shop with the website-URL: „https://1.6180.eu“ eingeht.

2. Conclusion of contract

The product presentations contained in the online shop "https://1.6180.eu" of ueneu GmbH do not constitute binding offers by the seller, but serve to make a binding offer by the customer.

Products are sold only to adults!

The customer may submit the offer via the online order form integrated in the online shop of the seller. In this case, after the customer has added the selected goods to the virtual shopping cart and has gone through the electronic ordering process, by clicking on the button concluding the ordering process, the customer submits a legally binding contract offer in relation to the goods contained in the shopping cart.

The ueneu GmbH can accept the offer of the customer within five days,

a) by sending the customer a written order confirmation by e-mail,

b) delivers the ordered goods to the customer, whereby the access of the goods at the customer is decisive,,

c) or by requesting the customer to pay after submitting the order.

If more than one of the aforementioned alternatives exists, the contract will be concluded at the time when one of the aforementioned alternatives occurs first. The period for acceptance of the offer begins on the day following the date on which the offer is sent by the customer and ends on the fifth day following the dispatch of the offer. If ueneu GmbH does not accept the customer's offer within the aforementioned period, this shall be deemed to be a rejection of the offer with the consequence that the customer is no longer bound by his declaration of intent.

When submitting an offer via the online order form of the online shop "1.6180.eu" of ueneu GmbH, the contract text will be stored by ueneu GmbH and will be sent to the customer after submitting his order together with the present GTC in written form (eg e-mail or letter).

Before binding the order via ueneu GmbH's online order form, the customer can recognize and correct possible input errors by checking his entries, as the entries will be displayed and can be corrected again in a confirmation window.

The order processing and contacting take place usually by E-Mail and an automated order processing. The customer must ensure that the e-mail address specified by him for the order processing is correct, so that the e-mails sent by ueneu GmbH (ueneu@posteo.de) can be received at this address. In particular, when using SPAM filters, the customer must ensure that all emails sent by ueneu GmbH or by third parties commissioned with the order processing can be delivered.

When ordering goods that may not be delivered to minors, the customer confirms by submitting the order that he has reached the minimum age required by law and undertakes to ensure that either he or one of his authorized person of full age takes the goods.

3. Right of withdrawal

4. Prices and terms of payment

If the payment method "SOFORT Überweisung" is selected, the payment is processed via the payment service provider SOFORT GmbH, Theresienhöhe 12, 80339 Munich (hereinafter "SOFORT"). In order to be able to pay the invoice amount via SOFORT Überweisung, the customer must have an online banking account with PIN / TAN procedure activated for participation in SOFORT Überweisung, must legitimize himself during the payment process and confirm the payment order to SOFORT. The payment transaction will be executed immediately and the customer's bank account will be charged by SOFORT. 5. Delivery and shipping conditions

The delivery of goods takes place on the way of dispatch and to the delivery address specified by the customer. When processing the transaction, the delivery address specified by the customer at the time of purchase is decisive. Notwithstanding this, when selecting the payment method PayPal, the delivery address specified there by the customer at the time of payment is decisive.

If the transport company sends the goods back to ueneu GmbH, because a delivery to the customer was not possible, the customer bears the costs for unsuccessful shipping. This does not apply if the customer is not responsible for the circumstance that led to the impossibility of delivery.

Any applicable customs duties are NOT included in the prices and must be borne by the customer.

If by law the delivery of the goods to the country of the customer is not possible and the goods are confiscated by authorities like customs or similar, this will not be replaced by the ueneu GmbH. The customer is responsible for checking the legal situation in the country of delivery.

6. Retention of title

If the ueneu GmbH delivers the goods in advance, it retains ownership of the delivered goods until full payment of the purchase price owed.

7. Liability for defects

7.1

If the purchased item is defective, the provisions of the statutory liability for defects shall apply.

7.2

The customer is requested to claim delivered goods with obvious transport damage to the deliverer and to inform the seller thereof. If the customer does not comply, this has no effect on his statutory or contractual claims for defects.

8. Redemption of action vouchers

8.1

Vouchers that are issued by ueneu GmbH free of charge as part of promotions with a specific period of validity and that can not be purchased by the customer (promotional vouchers) can only be redeemed in the online shop of the seller mentioned on the voucher and only during the specified period.

8.2

Action vouchers can only be redeemed by consumers.

8.3

Individual products may be excluded from the voucher action, provided that a corresponding restriction results from the content of the action voucher.

8.4

Action vouchers can only be redeemed before completing the order process. Subsequent offsetting is not possible.

8.5

Only one action coupon for a specific "promotion" can be redeemed per customer.

8.6

The value of the goods must at least equal the amount of the action voucher. Any remaining balance will not be refunded by the seller.

8.7

If the value of the action voucher is insufficient to cover the order, one of the remaining payment methods offered by the seller may be selected to settle the difference.

8.8

The balance of an action voucher is neither paid in cash nor become interest.

8.9

The action voucher will not be refunded if the customer returns all or part of the goods paid for with the action voucher as part of his statutory right of withdrawal.

9. Applicable law

For all legal relations of the parties the law of the Federal Republic of Germany applies

10. Jurisdiction

If the customer acts as a merchant, legal entity under public law or special fund under public law with its seat in the territory of the Federal Republic of Germany, the exclusive place of jurisdiction for all disputes arising from this contract is the registered office of ueneu GmbH (Berlin). If the customer is domiciled outside the territory of the Federal Republic of Germany, the place of business of ueneu GmbH (Berlin) is the exclusive place of jurisdiction for all disputes arising from this contract, if the contract or claims from the contract can be attributed to the customer's professional or commercial activity. However, in the above cases, ueneu GmbH is in any case entitled to call the court at the customer's place of business.
